Contributor Guidelines

The following Contributor Guidelines are part of our Terms and Conditions.

Mother’s Day Magazine offers a forum for contributors to publish content (“the Work”), whether in written, video or other format.

  1. Licenses and rights: In consideration of Mother’s Day Magazine publishing your content, you grant Mother’s Day Magazine the following rights/license in the Work:
  • Worldwide rights to publish in any or all print and electronic editions/versions of Mother’s Day Magazine, including domestic and foreign, whether in English or translated into a foreign language, including any successor, similar or replacement versions thereof;
  • The right to use the Work to advertise and promote Mother’s Day Magazine, its publications and/or its products as well as the right to create excerpts, teasers and summaries of the Work;
  • The right to use the Work in whole or in part on Mother’s Day Magazine’s website(s);
  • The right to republish, store, syndicate, distribute and/or sell reprints in print or electronic media of all or any portion of the Work in any language and in any country;
  • The right to publish the Work in whole or in part in a print or electronic edition of an anthology and in an electronic database;
  • The right to use your name and likeness in a fair and dignified manner and to publish information about you in connection with the advertising and promotion of Mother’s Day Magazine;
  • All rights granted by this agreement are granted in perpetuity and applicable in all media including, but not limited to, all electronic media, internet, wireless or mobile platforms whether now known or hereafter created.

If your Work has been accepted for publication in Mother’s Day Magazine, the same content must not be published elsewhere without a reference to and a link back to the published Work in Mother’s Day Magazine. You are welcome to share your Work published on Mother’s Day Magazine with your personal contacts via social media or email after publication. (If you share the referenced and linked Work on your personal blog or website, please include the first 100-200 words and then link to the Work published in Mother’s Day Magazine.)

  1. Delivery of Work. Prior to publication, you agree to deliver — as applicable — any related materials, written permissions for incorporation in the Work of any copyrighted materials, interviews and model releases.
  2. Editing and Publication of the Work. Mother’s Day Magazine has the right to edit or otherwise change the Work. You also agree to promptly make such changes in the Work as Mother’s Day Magazine may request. Mother’s Day Magazine retains the right to accept or reject the Work even after changes have been made by you and delivered to Mother’s Day Magazine. Mother’s Day Magazine may choose not to publish the Work after it has been accepted by us as satisfactory for publication. Mother’s Day Magazine reserves the right to remove any link/s at our discretion or to mark a link as “no follow.” You shall be responsible for all expenses incurred while performing services under this Agreement.
  3. Copyright. Except for the rights granted to Mother’s Day Magazine per this agreement, you retain all rights, including copyright, in the Work. We intend that this agreement shall cover Works published in any of the Publications after the date of this agreement.
  4. Representations and Warranties; Indemnification; Conflict of Interest.
  • You represent and warrant that you will be the sole author of the Work; that the Work will be original and not previously published in any form; that the Work will not knowingly contain any untrue statements or material that is deceptive, fraudulent or intentionally misleading, that it will not knowingly invade any right of privacy or violate any right of publicity or infringe upon any statutory or common law copyright or trademark or otherwise violate the rights of any third party or any applicable law or regulation, and that all statements in the Work which are asserted as facts are true and/or based upon reasonable research for accuracy. You agree to cooperate in the defense of any legal action brought against Mother’s Day Magazine arising from the publication of your Work and you agree to retain all notes, drafts and copies relating to the Work for three (3) years from acceptance.
  • You agree and represent that you will disclose to Mother’s Day Magazine in writing any actual or potential conflict of interest, including but not limited to any financial interest in any product, firm, or commercial venture relating to the subject of the Work.
  • You agree and represent that you will not use your association with Mother’s Day Magazine to advertise or otherwise promote or identify yourself in any speaking engagements or public appearances without the prior written consent of Mother’s Day Magazine. In addition, you will not use your association with Mother’s Day Magazine to solicit or accept free or discounted gifts or services.
  • You agree that you will not at any time or in any manner, either directly or indirectly, use for your personal benefit or divulge, disclose, or communicate in any manner any information that is proprietary to Mother’s Day Magazine. You will protect such information and treat it as strictly confidential. This provision shall continue to be effective after the termination of this Agreement.
  • You agree to indemnify and hold harmless Mother’s Day Magazine from all claims, losses, expenses, fees including attorney fees, costs, and judgments that may be asserted against Mother’s Day Magazine that result from the acts or omissions or breach of representations or warranties by you, your employees or your agents.
  • Mother’s Day Magazine, in its sole discretion, may publish, withdraw, postpone or alter any content you provide. You understand that you are responsible for any legal claims arising from the Work you provide, and that Mother’s Day Magazine intends to treat such Work as covered by Section 230 of the Communications Decency Act’s safe harbor.
  1. Disputes. All disputes between you and Mother’s Day Magazine (whether or not such dispute involves a third party) shall by resolved per the guidelines set forth in our Terms and Conditions.
  2. Contributor Guidelines: You agree to abide by the terms of the Contributor
    Guidelines provided to you, as amended from time to time, which are incorporated herein. You also agree to periodically check the guidelines for any amendments. Failing to follow the Contributor Guidelines will result in termination of this agreement.
  3. Relationship of the Parties: Nothing herein shall be construed to create an employer-employee relationship between Mother’s Day Magazine and you. You are not an employee or agent of Mother’s Day Magazine or any of its subsidiaries or affiliates. Mother’s Day Magazine will not provide compensation, fringe benefits, including health insurance benefits, paid vacation, or any other employee benefit, to you. You have the right to control the means, manner and method by which you create the Work, and you assume responsibility for the quality, scope and accuracy of the Work.
  4. Term and Termination: This agreement shall remain in effect until terminated by either party upon written notice. All provisions that, by their nature should survive termination, shall survive, including any grant of rights/license.
  5. Modification: Our Contributor Guidelines may not be modified, waived or discharged orally. Any modifications, waiver or discharge must be in writing and signed by you and Mother’s Day Magazine. Mother’s Day Magazine may assign this agreement in whole or in part and agreement shall be binding upon and benefit successors and assigns of Mother’s Day Magazine.
  6. Governing Law/Jurisdiction/Severability/Superseding Agreement: This agreement shall be governed by the laws of the State of California. The invalidity or unenforceability of any provision of the Agreement shall not affect the validity or enforceability of any other provision. This Agreement supersedes any prior agreement between you and Mother’s Day Magazine pertaining to the subject matter hereof. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
